Why do we exist?
The Thomas More Law Center (TMLC) was established as “the Christian response to the ACLU.” TMLC is dedicated to the defense and promotion of America’s Christian heritage and moral values, a strong national defense, and an independent and sovereign United States of America. It is a national nonprofit public interest law firm based in Ann Arbor, Michigan. It is made up of an aggressive team of lawyers who devote all their professional skills to the accomplishment of TMLC’s mission. It does not charge for its services. Bill O’Reilly acclaimed TMLC as the “Christian Antidote to the ACLU.”
Court decisions prompted by the ACLU and like-minded organizations are jeopardizing our national security and sovereignty, and systematically cleansing America of its Judeo- Christian heritage and moral values. TMLC is the strong voice of American Patriots in the courts.
What have you accomplished?
• LtCol Jeffrey Chessani, USMC, as commanding officer of the 3rd Battalion, 1st Marines was considered one of the most effective combat officers in Iraq . TMLC successfully defended him on trumped-up criminal charges designed to appease anti-war politicians and the liberal media. On November 19, 2005, in Haditha, Iraq, LtCol Chessani’s Marines were engaged in an intense, house-to-house, room-to-room firefight after they were ambushed on patrol. His Marines were accused of killing several civilians while pursuing the insurgents. LtCol Chessani was charged with failing to properly investigate and report on the killings of civilians. All criminal charges against him were dismissed. TMLC also defended him before an administrative Board of Inquiry wherein the Board found that there was no misconduct based on the preponderance of evidence. Chessani retired in 2010 with his honor and rank intact.
• Jesse Nieto’s youngest son, Marc, and 16 of Marc’s shipmates were killed in October 2000, by Islamic terrorists who bombed the USS Cole. Nieto works at Camp Lejeune, NC, a marine installation. After his son’s death, Nieto displayed various decals on his vehicle expressing anti-terrorist sentiments, such as “Remember the Cole, 12 Oct 2000,” “Islam=Terrorism,” and “We Died, They Rejoiced.” In July 2008 military police issued Nieto a ticket for displaying “offensive material.” After Nieto refused to remove the “offending” decals from his vehicle, the Base Magistrate issued Nieto a written order to remove his vehicle from the base until all decals were removed and banning his vehicle from all federal installations. TMLC challenged the constitutionality of the military’s ban on Nieto’s speech. In March 2010, a Federal District Court Judge ruled in Nieto’s favor allowing him to display his anti-terrorist decals.
• Brad Johnson, a highly respected math teacher for the Poway Unified School District in San Diego, California, was ordered to remove several banners from his classroom that contained historical slogans such as, “In God We Trust,” “One Nation Under God,” and “God Bless America.” School officials said his banners, which had been displayed for over 20 years, impermissibly promoted a Judeo-Christian viewpoint and might offend a Muslim student. TMLC filed a lawsuit on his behalf, and after 3 years of litigation, a Federal District Judge ruled on February 26, 2010, that the school district violated Johnson’s constitutional rights when it ordered him to take down his banners. The school district appealed the district court’s ruling to the federal Ninth Circuit Court of Appeals. That court has not rendered its opinion as of this writing.
• Tulsa, Oklahoma police Captain Paul Fields refused to attend or order his officers to attend a mandated Islamic propaganda event that had nothing to do with any official police function. As a result, Captain Fields, a 16-year police veteran, was stripped of his command and disciplined with time-off. TMLC joined a local attorney to defend Captain Fields’ constitutional right not to become a propaganda tool for the local Muslim mosque. This case is still pending in the Federal District Court in Oklahoma.
• TMLC was the first entity to file a federal lawsuit challenging the constitutionality of Obamacare -- just moments after President Obama signed the new law in March 2010. In July 2011, TMLC filed a petition for review in the U. S. Supreme Court, the first to reach the U.S. Supreme Court, following a 2-1 decision upholding Obamacare by the Sixth Circuit Court of Appeals.
• TMLC has filed several lawsuits defending the right of pro-life activists to express their pro-life message.
• TMLC drafted Michigan’s constitutional amendment that defines marriage as between one man and one woman.
